Thank you for choosing Caroline Nicholson Photography to capture your precious memories.  In order for our sessions to go as smoothly as possible the following Terms and Conditions apply to all bookings

By booking and paying for your session you agree to the following terms and conditions (please ensure you read the terms and conditions prior booking your session):

COVID-19 - ALL 2020 BOOKINGS

All sessions are undertaken on the understanding that all parties will adhere to the full government guidance, and you will not attend the session if you or any of your party exhibit symptoms of Corona Virus, or have been in contact with anyone who has tested positive for Corona Virus.  This is for the safety of me and my family as well as my other clients and the wider community.

All clients are asked to:

​

• Adult and children over 11 please arrive wearing a face covering, until such time as the shoot is set up and I indicate it is OK to remove your mask.

• Ensure your party is no larger than 5 people - please do not bring extended family or friends to the session.

• Maintain at least a 2 meter distance at all times throughout the session.

• Use hand sanitiser throughout the session.

• Please do not bring items from home, such as outfits to change during the session.

• ​Please read and sign the Covid Consent Form to confirm that you are feeling well and have not had any symptoms of the virus in the previous 7 days.

• Please check and adhere to any updated guidance from the Government and check with Caroline Nicholson Photography prior to your booking, should the guidance change at short notice.

​BOOKING & PAYMENT
A booking fee is required at the time of booking in order to reserve the session.  Payment by the Client is due a minimum of 48 hours before your photo shoot. Payment may be paid by bank transfer (or credit card upon arrangement) only due to the current government guidelines and so as to avoid the handling of cash.  Session dates and times are not secured until the booking  has been paid in full. All bookings are final. If for any reason Caroline Nicholson Photography has to cancel your photo shoot you will first be offered to change the date or receive a full refund of your booking fee.  Should UK Government Guidelines mean a shoot cannot go ahead, you will be contacted to re-arrange.

YOUOU SESSION
The Client is guaranteed to a photo shoot up to 5 family members (as per current guidelines) at the pre-determined location (depending on the package). Travel costs may be incurred outside of Medway, Kent.  Any additions, such as more time, the number in the party (if compliant with guidance) or travel can be negotiated but may incur a fee. The booking fee includes the shoot itself, time editing and preparing the selected images for viewing, unless the client purchases a pre-paid collection.  If your child becomes ill, upset or does not want their photo taken during the session, whilst very unusual and unfortunate, Caroline Nicholson Photography cannot be held responsible and money will not be refunded.
 

LATE ARRIVALS
Your session time will be pre-agreed and must be adhered to. Any Client that is late arriving to a session will have the amount of time late deducted from the time allowed for the shoot - the session will NOT be extended. This may also result in a reduction of the number of edited images supplied.  Please do not ask to extend the session as this may impact on other clients.
 

IMAGE PROOFS & PHOTOGRAPHY PRODUCTS
Images will be fully edited and available for viewing within four weeks of the session date and uploaded to a protected gallery for viewing. For security purposes, proofs on the online gallery are watermarked and cannot be removed under any circumstances. These images must not be screen dumped, saved or copied - doing so will constitute a breach of Copyright under UK law and may result in legal action.  The gallery is visible for a week. There will be a charge of £10 to re-activate the gallery due to extra proofing gallery subscription fees.  The number of images available to view will be dependent on the package booked.
All images are professionally edited (including removing minor blemishes only). For extensive retouching (for example the removal of tattoos, scars etc.) there is an additional fee of £10 per image.
Digital files are delivered via web download only due to current government guidelines and to avoid contact where possible. There are two folders: high resolution images without watermarks suitable for printing (strictly personal use only) and low resolution files with watermarks which must be used for sharing and social media.
 

CLIENT USAGE
The Client is obtaining prints/digital files for personal use only or to give to family and friends, and shall not sell said prints/digital files or authorise any reproductions thereof by parties other than Caroline Nicholson Photography. Permission will not be given to enter the pictures into any competitions or publications, nor will permission be granted for use by the press or print media.  (A license to do so must be obtained should you wish the images to be used more widely.  This will require a contract and payment of a fee).

Caroline Nicholson Photography will store all images for three months only. However the purchase of the original files releases Caroline Nicholson Photography from any liability due to loss or damage of the images, and also from any obligation to maintain copies of any digital file. The Client is responsible for checking the content of the files after receiving it.  The client is responsible for creating back-ups of the digital content (delivered by download). 

Caroline Nicholson Photography cannot be held responsible for poor quality prints from printing shops or online printers. We are happy to provide you with recommended suppliers or provide high quality prints from professional labs.
 

COPYRIGHT
The entire copyright is retained by Caroline Nicholson Photography at all times throughout the world. Editing or altering of the images in terms of style, colour, additions, subtractions, cropping or any other form of post-production or enhancement is not permitted. Copying or saving images from proofing gallery is not permitted and will be treated as a breach of the agreed term and conditions.
 

USE OF IMAGES BY CNP
The Client hereby allows Caroline Nicholson Photography to display any images covered by booking the session and to generally promote the business by means of social media advertising, websites, exhibitions, competitions, magazine articles, publicity material, and other such media providing that the images are used lawfully and without damage to the Clients. Clients should state at the time of booking, in writing, if they do not wish for images to be used in such manner.
 

EXPENSES
Where extra expenses or time are incurred by Caroline Nicholson Photography as a result of alterations to the original agreement by the Client, or otherwise at their request, the Client shall give approval to and be liable to pay such extra expenses or fees at the photographer's normal rate.
 

RETURNS
Due to the nature of the product and service, no return, exchange or refund is available on any session or item once booked.  Nor will any refund be provided once the image proof has been approved, and an order placed. 
All items are quality controlled before being supplied and as such will be supplied in perfect condition.  Items deemed poor quality can only be returned upon proof of deterioration and will be replaced at no extra charge to the Client. All clients will be required to check and sign for items at the point of delivery to ensure perfect quality.  Returns will not be considered for incorrectly ordered items or sessions where the appointment time is missed.
 

CANCELLATION & POSTPONEMENT
A booking is considered firm as from the date of confirmation and payment.  Accordingly Caroline Nicholson Photography will, at its discretion, charge a fee for cancellation or postponement if required.
 

CLIENT CONFIDENTIALITY
Caroline Nicholson Photography will keep confidential and will not disclose to any third parties or make use of material or information communicated in confidence for the purposes of the photographic session, save as may be reasonably necessary to enable Caroline Nicholson Photography to carry out its obligations in relation to the commission.
 

APPLICABLE LAW
This is governed by the laws of the United Kingdom and in compliance withe DPA, GDPR, and the copyright laws of the UK.
